Friedman + Huey Associates LLP ("Firm", "we", "our", or "us") respects your privacy and is committed to protecting it through our compliance with this policy. This policy describes how we collect, process, retain, and disclose personal data about you when providing services to you through our mobile application (“Client App”) and our practices for using, maintaining, protecting, and disclosing that information.

Our Client App is offered exclusively to existing Firm clients for the secure submission of tax-related documents. Clients may either submit a scanned or photographed document or upload an existing saved file from their device directly to their client folder in the Firm’s ShareFile account. This policy applies only to information we collect through the Client App and does not apply to information collected by us offline, through our websites or client portals, or through any third parties.

We may provide additional or different privacy policies that are specific to certain features, services, or activities.

Please read this policy carefully to understand our policies and practices regarding your information and how we treat it. By interacting with our Client App or providing us with your information, you agree to the collection, use, and sharing of your information as described in this privacy policy. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the Client App after we make changes as described here is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Children's and Minors' Data

Our Client App is not intended for, and we do not knowingly collect any personal data directly from, children under the age of 18. If we learn we have collected or received personal data directly from a child under 18 years old without verification of parental consent, we will take reasonable measures to delete that information as soon as possible.

Personal Data That We Collect or Process and How We Collect It

"Personal data" is information that identifies, relates to, or describes, directly or indirectly, you as an individual, such as your name, email address, or any other identifier we may use to contact you online or offline.

The types and categories of personal data we collect or process include:

Information You Provide Directly:

·         Account and contact information, including first and last name, email address, User ID (from AWS Cognito), authentication tokens (stored securely on your device), account creation and update timestamps, and information contained within any client notes (if you submit them).

·         Tax entity information, such as entity names, internal client codes, and entity associations tied to your client profile. This information is already included in your client file with the Firm.

Information Collected Automatically:

·         Usage and technical logs, such as authentication session information, API request logs, and error and diagnostic logs.

·         Stored Information and files. The Client App also may access metadata and other information associated with files stored on your device. This may include, for example, files you permit the Client App to access (but not retain a copy of) when you upload them to your client file in ShareFile, metadata about those files (name, size, timestamp), submission status, and document count.

If we combine or connect non-personal statistical or technical data with personal data so that it directly or indirectly identifies an individual, we treat the combined information as personal information.

Permissions

·         Camera: the Client App will use your device’s camera when you choose to scan documents.

·         File access: the Client App will use file access only when you choose to upload documents stored on your mobile device.

Revoking these permissions may limit your upload features but will not prevent general use of the Client App.

How We Use Your Information

We use information that we collect about you or that you provide to us, including any personal data, to:

·         Provide the Client App to you and permit the Firm to receive client documents for tax preparation, associate tax documents with your client file, and provide customer support related communications to you regarding the Client App’s functionality.  

·         Monitor the performance, security, and troubleshooting of the Client App.

·         Fulfill any other purpose for which you provide it.

·         Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

·         Notify you when Client App updates are available and about changes to any products or services we offer or provide through it.

·         Comply with our legal, regulatory, and professional obligations.

·         In any other way we may describe when you provide the information.

·         For any other purpose with your consent.

Who We Disclose Your Information To

We may also disclose personal data that we collect or you provide as described in this privacy policy:

·         To contractors, service providers, and other third parties we use to support the Firm. This includes Amazon Web Services (AWS) to support the Client App with authentication, backend APIs, and logging, and ShareFile for secure document storage within your client folder.

·         To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Firm’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal data held by the Firm is among the assets transferred.

·         To fulfill the purpose for which you provide it.

·         For any other purpose disclosed by us when you provide the information.

·         With your consent.

We may also disclose your personal data:

·         To comply with any court order, law, or legal process, including to respond to any government or regulatory request.

·         To enforce or apply our Client App End User License Agreement  https://fhassoc.com/app-license-agreement/ and other agreements, including for billing and collection purposes.

·         If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of our organization, our clients, or others.

Your Rights and Choices About Your Information

We are committed to offering you choices about your personal data. As an existing client of the Firm, you have the right to request correction, access, or deletion of your personal data, subject to certain legal exceptions. You may access documents uploaded with the Client App within your ShareFile account from the Firm and download a copy, make changes to those documents, or delete those documents. For all other personal data collected by the Client App, please reach out to your tax professional or contact us using the information in the Contact Us section below for assistance. We may not be able to fully comply with all deletion requests, as we are required to maintain certain documentation for recordkeeping and tax purposes.

You may also choose to revoke the permissions given to the Client App to use your device’s camera or to access your device’s local file storage. Revoking these permissions may limit your upload features but will not prevent general use of the Client App.

The Client App does not use any third-party advertising, tracking SDKs (software development kits), or cross-app analytics.

Data Transfers

The Firm operates in the United States, and the Client App is available for United States residents who are existing clients of the Firm. If you are a resident of another country, please note that your personal data may be transferred to a country that may not have laws that provide the same degree of protection for personal data as your home country. By downloading and using the Client App, you acknowledge that your personal data will be processed in the United States. 

How We Protect Your Personal Data

We use commercially reasonable administrative, physical, and technical measures designed to protect your personal data from accidental loss or destruction and from unauthorized access, use, alteration, and disclosure. Unfortunately, no website, mobile application, system, electronic storage, or online service is completely secure, and we cannot guarantee the security of your personal data transmitted to, through, using, or in connection with the Client App. Any transmission of personal data is at your own risk. We are not responsible for circumvention of any privacy settings or security measures included through the Client App.  

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) login credentials for access to the Client App, you are responsible for keeping your login credentials confidential. You are responsible for taking steps to protect your personal data against unauthorized use, disclosure, and access, including by securing your login credentials to the Client App.

How We Retain Your Personal Data

We keep the categories of personal data described in this policy for as long as reasonably necessary to fulfill the purposes described or for as otherwise legally permitted or required, such as maintaining the Services, operating our organization, complying with our legal obligations, resolving disputes, and for safety, security, and fraud prevention. This means that we consider our legal and business obligations, potential risks of harm, and nature of the information when deciding how long to retain personal data. At the end of the retention period, personal data will be deleted, destroyed, or deidentified.

Generally, account data and contact information is retained while your client relationship is active and will be destroyed following our Firm’s legal retention schedule following termination of your client relationship. Documents uploaded through the Client App are not stored within the Client App; instead they are securely stored in your client folder within ShareFile and will be retained in accordance with our legal requirements and the Firm’s retention policies. Submission metadata will be retained in accordance with our legal requirements and Firm retention policies for Firm records and audit purposes, logs are retained for 30 days, and authentication tokens remain on-device until logout.

Changes to this Client App Privacy Policy

We may update this policy from time to time, and we will provide notice of any such changes to the policy as required by law. The date the privacy policy was last updated is identified at the top of the page. We will notify you of changes to this policy by updating the "last updated" date and posting the updated policy within Client App. We may email or otherwise communicate reminders about this policy, but you should check our Client App periodically to see the current policy and any changes we have made to it.
